After getting shot down attempting to rewrite the BP Settlement by Judge Barbier several times, they are now trying to get their way in the 5th circuit.</p>
<p>BP is attempting to eliminate numerous categories of claimants, we have been telling you this for the last month.</p>
<p>So when you see their commercials on T.V., telling you how well they are treating the people along the Gulf.</p>
<p>Know the TRUTH, THEY ARE NOT ON YOUR SIDE. Actions speak louder then words.</p>
<p>This is all about money, and BP is doing it`s best to save theirs.</p>
<h3>Recent BP Settlement History:</h3>
<ul>
<li>BP sues Pat Juneau for misinterpreting how he is suppose to administer funds under the terms of the BP Settlement. Let me tell you something, we process many BP Claims in house and these people stick to the letter of the Settlement. All BP wants to do here is exclude certain categories, professionals, construction, media, and agriculture are the prominent.</li>
<li>BP has tried several times to rewrite the BP Settlement, and tried to enroll the Judge and the P.S.C. The P.S.C. and the Judge have stood firmly, holding BP to the terms of the Settlement.</li>
<li>BP uses appeals as a method to stall payments, overwhelming the DeepWater Horizon Settlement Appeals Process.</li>
<li>BP sets up traps within the BP Settlement, such as the Customer Mix Test, if a Claimant is not covered under a straightforward V Trend model, most will never see a dime. We are woking to fix that.</li>
<li>BP agrees to pay stockholders 8.5 Billion for losses and expedites payments, but not the people of the Gulf.</li>
<li>BP hires Feinberg who declares himself Independent until the Judge ORDERS him to Stop, meanwhile over 200,000 people take his devilish Quickpays.</li>
<li>BP now appeals Judge Barbiers Decision to the 5th Circuit, and wants to eliminate dozens of categories they initially agreed to pay under the terms of the BP Settlement.</li>

<h3>What are we seeing NOW</h3>
<p>The DeepWater Horizon Settlement has accelerated it`s processing capabilities. Postlethwaite &amp; Netterville, the accounting firm that is now handling the majority of the BP Claims seems to be doing a good job, at the very least, much better then their predecessor. If there are issues with a claim, we are often given a phone call, or an email, and time to cure the issue before incompleteness notices, or other notifications are given. This has been a relief, and a much needed departure from past processing procedures. We can tell you from first hand experience that they strictly adhere to the terms of the BP Settlement.</p>

<p>This means that many different types of claims could be excluded from the economic settlement.</p>
<p>BP has asked the 5th circuit to expedite the hearing and they have agreed.</p>

<p>If your claim is one of those appealed by BP, and the 5th circuit reverses Judge Barbier, you will not be able to make further claims to the DeepWater Horizon Settlement.</p>
<p>If your claim is filed before the potential reversal,  the common thought is your BP Claims will be grandfathered in, but they will have to meet some prerequisites.</p>

<p>This is the TRUTH. The new leadership of the fund and the Judge are doing the next right thing on a regular basis. Is the system perfect, hell no, but people within the Fund and the Judge are doing their best to get you paid, as BP has tried their best to put up road blocks.</p>

<p>Tonight The Judge put forth an Order to STOP that. Here is the important part.</p>

Upon the filing of an appeal pursuant to Section 6.1.2.4 of the Settlement Agreement, BP shall clearly and specifically designate in the Reason for Appeal section of its BP Portal that the appeal is based only on one or more of the legal issues previously </span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">decided by the Court and as referenced in this Court’s Order of April 9, 2013. </span></p>
<p><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">2. The required designations to be provided by BP shall use the following specific language regarding </span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">the three legal issues referenced in this Court’s prior rulings:<br />
</span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">(a) </span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">“Contribution</span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">s/Grant Revenue for Non-</span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">Profits issue;”<br />
</span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">(b) </span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">“Alternative Causation issue;” or</span></p>
<p><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">(c) </span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">“Matching of Revenue and E</span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">xpenses </span>issue.”</p>
<p><span style="font-size: 12.000000pt; font-family: 'Times New Roman';"> 3. For any appeals so designated, such appeals are hereby denied based on this Court’s </span><span style="font-size: 12.000000pt; font-family: 'Times New Roman';">prior rulings. The Claims Administrator is instructed to refrain from issuing the Notice of Appeal, which would otherwise trigger the further appeals process, and the Claims Administrator is to refrain from assigning such appeals to an Appeal Panel. The Claims Administrator is instructed to proceed with final processing of such claims and issuing payment in accord with the terms of the applicable Eligibility Notice. </span></p>

<h2>So What Does This Mean</h2>
<p>It means the Judge is not going to let BP Appeal Claims, so they can stall paying you, when your claims meet the above requirements. This has been going on for awhile now, and it is BP`s latest stall tactic, and the Judge just took it away, by a court order.</p>
<p>It means faster pay outs, it shows what I have been trying to tell ya`ll for months, and it puts BP on notice, The DeepWater Horizon Settlement, and the people running the show are not to be trifled with, and they ALL have had enough.The fact is they want to pay you, and will, if your claim is prepared properly. The sad fact is, most are not.</p>
<p>BP needs to STOP with the gamesmanship, and start paying claims. Stall tactics through the Appeals system run by David Duval, that will only tax the resources of the Deepwater Horizon Settlement will not be tolerated.</p>

<p>BP is expected to appeal to the 5th circuit, where once again they will most likely not find any relief, why, because they signed the BP Settlement, and they will not be allowed to rewrite it.</p>
<p>Pat Juneau is doing an excellent job administering it, and everyone knows BP is just out to save money.</p>
<p>BP was trying to change the Settlement so they did not have to pay people in the following Industries.</p>
<ol>

<li>Agriculture Industry</li>
<li>Professionals such as Lawyers, CPA`s, and Doctors</li>
<li>and more, its a long list, etc., etc., etc.</li>

<p>The BP Settlement is what it is, consider it etched in stone, and if you meet the terms of the Settlement you will get paid.</p>
<p><strong>Judge Barbier also commented on BP suing Pat Juneau for doing his job today</strong>. He said, &#8221;As a matter of law, how can a claims administrator be in breach of his contract if all he&#8217;s doing is applying it as he believes it should be applied, and now as ordered by the court?&#8221; Barbier asked. &#8220;How can that possibly be a breach of contract.&#8221;</p>
<p>We applaud the Judge for sticking up for the people and the Claims Administrator today.</p>
<h2>Incomplete BP Claims</h2>
<p>The biggest issue many have had is presenting a proper <a title="bp claims" href="http://bpclaims.org">BP Claims</a> package to the DeepWater Horizon Settlement Fund. This results in the majority of incompletes.</p>
<p>There have been other issues that we hear about on our facebook page of people getting incompletes for information that is already in the claim package, we heard of that more frequently about 6 months back, but evidently there still may be some issues, however we hear about this far less frequently now.</p>
<p>Some of this has been learning curve issues for those of us in the processing business, but after getting a number of successful claims through, we pretty well have this down to a science.</p>
<p>What people who handle their own BP Claims fail to realize is that when you handle literally hundreds or thousands of claims, as we and our strategic partners do. We build relationships with the people processing the claims, we have Liaisons  CPA`s,  and processors, that all work within the DeepWater Horizon Settlement infrastructure, and quite often instead of getting Incomplete notices we get a phone call or an email, letting us know what we have to adress. This saves time, and frustration.</p>
<h2>Liens and Lawyers</h2>
<p>The Judge also admonished a few attorneys today for putting liens on BP Settlement Claims. We have been hearing a lot about this recently. If an Attorney has put a lot of time into a file, and the person decided to go elsewhere, the Attorney may elect to put a lien on the file. That is understandable, what is not understandable is when you may have engaged them but never gave them any information and they try to put a lien on your file for 25%. It gets even crazier when the client claims he never even engaged the Attorney, but the Attorney is still putting a lien on their file, and that has happened.</p>
<h3>AR1`s help clients move from one firm to another</h3>
<p>There is an apparatus in the DeepWater Horizon Settlement that deals with the lien issues, we will probably see this come into play more often in the near future. There is also a form known as an AR1 that allows clients to move from one attorney to another, or from an Attorney to a processor, or vice versa. Ar1`s have made moving claimants from one firm to another much easier.</p>

As I stated in the last several blogs, BP is trying to rewrite the DeepWater Horizon Settlement, the leadership of the Settlement and Judge Barbier are holding their feet to the fire. Nothing could have proved it more than the stance the BP Settlement Leadership has taken against BP in recent weeks and months as BP tries to change the terms of the <a title="bp settlement" href="http://bpclaims.org">BP Settlement</a>. I do understand many peoples’ frustrations, as BP Claims are slow to get paid. Please understand the claims are getting paid, and the people that run the program have multiple issues to deal with, such as this assault from BP.<br />
Even the Plaintiff Steering Committee has come armed to the teeth to defend your rights under the settlement. I have read the most recent documents the PSC has presented to the court, and they are awesome. They stood up for the people, they were relentless in attacking BP`s stance, and they were right.</p>
<p>BP is trying to wiggle; they have realized uncapping the economic settlement was not a good idea, even with their traps, such as the Customer Mix Test, putting deadlines for people with Seafood Compensation Claims, fraudulent OPA deadlines, and the list goes on. I am not an Attorney, but this is what I believe. They cut a deal that they are trying to back out of and that is the fact.</p>
<p>BP is out to screw you; shocking but true. First they gave you Feinberg, who claimed himself Independent until the Judge stopped him from saying that by a court order; as they were paying him an exorbitant amount of money. At the same time he was convincing people, specifically those in the seafood industry, to accept quick pays. Unfortunately, after he starved them out, over 200,000 people took them. They should be able to come back to the table.</p>
<p>Then they negotiate a Settlement that they agree to, and after they realize how much they may actually have to pay, they want out. All of this on the heels of the news that they knew an explosion could be imminent days before it actually happened.</p>
<p>What to expect from the hearing on the 5th? Nothing. The Judge will rightfully hold BP to the settlement, BP will appeal to the 5th circuit, claims will continue to get paid, and eventually BP will have to pony up. They will not be able to wiggle out of this one.</p>
<p>However, if BP gets their way, construction folks, professional people and AG families will all be under fire, and probably apt not to get paid. If I fell into one of these categories I would make sure my BP Claims were filed sooner rather than later.</p>
<p>So all of those commercials you see on TV, the hype, the PR machine, it`s all BS and BP is proving that in court. If they were people of their word, and they are not, they would be living up to the terms they agreed to under the BP Settlement. It`s just that simple. My Grandfather always said, look at people’s actions, not their words, and he was never more right.</p>

<p>It is apparent that Pat Juneau and Judge Barbier are sticking to the letter of the Settlement, but outside forces would like to change all of that, and just might, and that could affect a lot of people &#8211; if BP Gets their Way.</p>
<p><strong>At this point BP is actually suing Pat Juneau the Claims Administrator of the BP Settlement</strong> &#8211; Shame on them, tactics such as these could be construed by some as extortion.</p>
<div>If BP can manipulate the courts and the Settlement, and they are trying, numerous groups could be excluded from the Settlement. <strong>If your claim falls into an excluded group, but it is already in the settlement, you are considered Grandfathered in.</strong></div>

<h2>Claim Groups BP is trying to Exclude</h2>
<p>Please go to the bottom of the post for the complete list, and it is a long list.</p>
<p>Most notable are Contractors, Farmers, Aquaculture, Media Companies, and Doctors. Lawyers are also on the list.</p>
<p>Why is BP trying to change the BP Settlement &#8211;  basically because they have started to see the numbers roll in from these groups, and they are staggering. Some have told me that BP is not happy with their Attorneys who created the initial Settlement.</p>
<p>The Reality is, it`s all about money, when it should be, recognizing the trickle down effect this horrific event had on our economy and our ecology.</p>
<p>The Gulf Coast Region was in a recovery from the Housing Disaster when this happened, and the Oil Spill knocked that recovery back 3 years.<br />
Many industries were affected, as the recovery was knocked for a loop by BP. To this day I can not think of one Industry that did not feel the affect.</p>
<p><strong>BP Approves over 8 Billion Dollar Payout</strong> &#8211;  Was it to the Victims of the Oil Spill?  No,<strong> it was to it`s Shareholders</strong>.  It is suppose to be paid out in the next 12-18 months, that`s a whole lot faster then it got the money to the Victims of the Oil Spill. This is typical of how BP thinks, putting their own in front of what should be a priority of the majority.</p>
<p>IF a deal is cut between BP and the PSC and approved by the Judge, or if it is approved by the Courts, any of the below Industries could be out of the Settlement, if they have not yet filed with the Deep Water Horizon Settlement. If you have filed with the Settlement, you are grandfathered in so to speak.</p>
<p>My thoughts, and I am not a lawyer, is I would make sure that my BP Settlement Claims got filed ASAP.</p>
<p>The Hearing on  &#8221;BP&#8217;S EMERGENCY MOTION FOR A PRELIMINARY INJUNCTION AGAINST THE CLAIMS ADMINISTRATOR AND SETTLEMENT PROGRAM TO ENJOIN PAYMENTS AND AWARDS FOR BUSINESS ECONOMIC LOSS CLAIMS BASED ON FICTITIOUS &#8220;LOSSES&#8221;"  is scheduled for April 5th.</p>
<p><strong>We feel time is of the Essence to get Claims in that could be Excluded, into the BP Settlement, so they are grandfathered in</strong>.</p>

<p><a href="http://bpclaims.org/wp-content/uploads/2012/09/bp-settlement.jpg"><img class="alignleft size-full wp-image-3383" alt="bp settlement" src="http://bpclaims.org/wp-content/uploads/2012/09/bp-settlement.jpg" width="196" height="219" /></a>  7.8 Billion Dollars will not be enough to cover the <a title="bp settlement" href="http://bpclaims.org">BP Settlement</a>.  We had told you this before, when they first announced this number, the 7.8 Billion was pie in the sky. The real number will exceed 20 Billion Dollars, that is our projection.  Remember the BP Settlement is uncapped except for those with seafood compensation claims, and that still doesn`t make any sense. You would think that the fishermen on the front lines of this whole disaster would be the ones uncapped.</p>
<p><a title="bp settlement" href="http://www.foxbusiness.com/news/2013/03/08/bp-expects-gulf-spill-claims-to-climb" class="broken_link">Fox news</a> reported today that BP will not even release new projections, and that is probably a good idea. Over the last several weeks BP has tried to restrict certain types of claims and tighten up qualifications for existing claims, but the Leadership has fought back, and won the first round. BP does not want to live up to the deal they originally cut, what a shocker. Evidently they may appeal to the 5th circuit.</p>
<h2>One Check List for BP Settlement Incomplete&#8217;s</h2>
<p>So what is BP doing to thwart the BP Claims process, they are called incomplete notices, appeals, and whatever else they can think of. Instead of giving us one checklist to tell us where a claim is deficient, we are receiving an incomplete notice each time a claim needs to be amended. So understand this, and this is very important, each time a claim is given an incomplete notice, it has to go back in the que, when it goes through processing for the second time, it may very well be given an incomplete notice again, traditionally we are seeing that take 2-6 weeks, then the claim gets hit with another incomplete notice and then again another 2-6 weeks. This area of the BP Claims process is clearly broken.</p>
<h3>We need ONE CHECKLIST, to cure all the deficiencies, we have been calling for this for months.</h3>
<p>At the same time we are seeing BP Settlement Claims get paid, but they are the smaller ones. They seem to be working their way up the ladder, saving the big ones for last. Many of the people in this business I speak to on a daily basis, think this is exactly what they are doing, and so do I. BP Claims should be paid on a first in, and a first out basis, size shouldn`t matter, all though we all know size does.</p>
<h2>DeepWater Horizon Settlement to liberal: Really</h2>
<p>BP has taken the stance that the Deepwater Horizon Settlement Leadership was too liberal, with some of the initial payouts, and tried to tighten things down over the last several months. The Judge and Patrick Juneau have stemmed this recent BP assault, we will see if  payouts come on a more consistent basis, specifically the larger claims. Time will tell.</p>
<p>The fact remains we are seeing some firms and processors get paid on a more consistent basis then other firms and processors. Many groups have stopped taking on BP Settlement Claims out of frustration with the process. Not us, we are in this for the long haul, we have have been here from the beginning, and we will be here to the end, whenever that is.</p>
<h2>Oil Spill Claims Assistance</h2>

It was by design, BP and the Fund, were stalling these claims, as they sorted things out, and today Judge Barbier put a stop to it. The <a title="deepwater horizon settlement" href="http://bpclaims.org">Deepwater Horizon Settlement</a> led by Patrick Juneau with the help of Judge Barbier went to bat for the people. The people won.</p>
<p>This process has not been easy for many, about 2 days ago we were given a list of these stayed claims, it was something we thought was happening, but we had not seen it in black and white, this was an official list, it should have been made  available to the general public. We are publishing it here..The Stay List is at the end of this post.</p>
<p>This is what we are seeing from the Fund, they are paying claims. We have long advocated for the settlement, and they needed time to get all of the wheels on the bus, the wheels are on the bus. We are seeing a rhythm to the  claims process, claims are getting paid on a regular basis.</p>
<p>I wish I could say this is happening for everyone, but I can`t. I do believe that certain firms with credibility with the Fund are getting preferential treatment because they know that the Claims being presented are credible and have their documentation all together.</p>
<p>As a fact some firms are getting claims paid regularly, some are not, I think is based on the performance of those firms, and how they prepare BP Settlement Claims. The fact is some know what they are doing, and some just don`t have a clue, and that is recognized by the Fund. Now this is conjecture I am not a lawyer, but I know most of the players in this, and it`s just the way it is as I see it.</p>
<h2>OPA Claims may still have Time to File</h2>
<div><span style="font-family: Arial; font-size: small;">There is a possible exception on the OPA deadlines, which could give certain businesses some extra time to submit a claim - OPA states &#8221;3 years from the time people we aware of damages&#8221; with the oil spill occurring in 2010, time is of the essence.  Basically if you did not realize you were impacted by the Oil Spill till a year after the Oil Spill, the argument is you still have time to file under OPA, and some Attorneys are ready to make that argument.</span></div>
