We have been hearing recently from shrimpers that are coming back in from the Gulf of Mexico and the Bays about the Health of the Gulf, the news is not good. Shrimp catches are down, way down. They are picking oil up in their nets more often then not. The shrimp and killfish they are finding in their nets have lesions, they are missing eye sockets, and they have a myriad of other issues.</p>
<p>The FDA says it`s fine to eat, we all know better. We have been told by numerous sources they just raised the testing levels of what is acceptable. The Shrimpers themselves have never seen anything like this in generations.</p>
<p><strong>They are being forced to shrimp because many had taken <a title="“The Big Lie” BP Claims Quick Pays" href="http://bpclaims.org/bp-claims-bp-business-claims/the-big-lie-bp-claims-quick-pays-and-seafood-harvesters/">Quick Pays</a>, and it is the only hope of putting food on the table this year. The collapse of the Northern Gulf `s Seafood Industry can not be denied. If the <span style="font-style: italic">BP Settlement</span> does not address these issues, they in essence are forcing people to fish and exposing all of us to these deadly catches.</strong></p>
<h2>BP Settlement Quick Pays can still file Claims for VOO and Medical</h2>
<p>If you took a Quick Pay or a final, you can still be a part of the VOO Settlement Class and the Medical Settlement Class under the <u>BP Settlement</u>. Many of you are sick but are attributing the High Blood Pressure to Stress and other factors. If you worked in the water or around the water during the Spring, Summer and Fall of 2010, odds are you are sick from the dispersant corexit and the oil.</p>
<p>There are tests that can help show this, one is called a Volatile Organic Compound Test, it measures the heavy metals in your body. If you are a fishermen, shrimper, crabber, and especially oystermen and clammer`s you need to go see a doctor.</p>
<p>We are hearing far to often of strokes and heart attacks, and are seeing a trend that is alarming. Many of you have not connected dots here. The BP Settlement can help you monetarily speaking, but you need to take the initiative when it comes to your health. The National Institute of Health is in the region taking hair, nail clippings and blood samples, they wouldn`t be there if it wasn`t serious.</p>
<p>The BP Settlement can only address so much, but the door is open if you took a Quick Pay to be a part of the BP Settlement for Medical and VOO Claims.</p>
<h2>The BP Settlement and some random Thoughts</h2>
<p>If the Northern Gulf goes into a full collapse, and experts are getting increasingly concerned about this, what do you think will happen to all the tourism. Owners of tourism and other related businesses please take note here. This will affect us all.</p>
<p>If the BP Settlement is to be fully utilized there needs to be some changes. First and foremost Quick Pays need to be addressed as soon as possible. You can not ask a man or a woman not to put food on the table for their families, if given the option of catching some tainted seafood, or their families starving, the choice is quite easy.</p>
<p>The BP Settlement needs to be proactive in its approach to paying people, especially paying those on the front lines. The BP Settlement should recognize the businesses that exist because of the Fishermen, Crabbers, Shrimpers and Oystermen, seafood processors and other assorted upstream businesses should receive higher multipliers if they choose to be a part of the BP Settlement.</p>

<p>Many of you are entitled to multiple claims under the BP Settlement. Lets take for example a Fishermen that worked on the VOO Program who lives on the water.</p>

<h2>Who runs the Deepwater Horizon Settlements Program</h2>
<p>The Deepwater Horizons Settlements will be run as a court supervised program under Judge Barbier and the administrator Patrick Juneau.</p>
<p>The entities processing the claims will remain the same from the GCCF, this is a concern. New guidelines will of course be in place, but after the debacle of the GCCF and knowing what we do about their internal processing methods, we will be watching them like a Hawk, and letting you know how it goes.</p>

<p>Mind you this is just how you figure your baseline there are other factors and multipliers that will be added to complete your Settlement equation. There are various multipliers for various types of claims and the zones those claimants inhabit.</p>
<h2>BP Settlement Zone A Example</h2>
<p>Here is how you would find your baseline under the <u>BP Settlement</u> for a Zone A Business under the BP Settlement. Take 3 consecutive months or more from 2010 after the Oil Spill, take those same months in 2009, 2008, and 2007 and create an average. You can use 2009, 2009, and 2008, or 2009, 2008 and 2007.</p>
<p>So lets say you used 5 consecutive months in 2010 after the spill and you made 100,000.00. You then take the same 5 consecutive months for 2009 and 2008, and came up with an average of 175,000.00, therefore you had a 75,000 loss for 2010.</p>
<p>The RTP or Risk Transfer Premium is 2.5 which means your multiplier is 3.5, so take 3.5 X 75,000.00 and your total is 187,500.00, that is your baseline loss, there are multiple ways to increase that number under the BP Settlement, but it gets pretty complicated.</p>
<p>There are several different zones and Multipliers for different areas and types of claims.</p>
<h2>Environmental and other concerns</h2>
<p>Report after report has been coming out showing how disastrous the effects of corexit and oil have had on the environment and on us. The data is just flat out not pretty. A <a title="bp settlement" href="http://www.courthousenews.com/2012/05/04/46224.htm">diver</a> that had two of his colleagues commit suicide and he has seizures after diving through contaminated water after being assured by a BP executive it was safe.</p>
<p>The death and illness of the blue crabs and the <a title="dolphins of Barataria bay" href="http://www.huffingtonpost.com/2012/03/23/barataria-bay-dolphins-oil-exposure_n_1375879.html">Dolphins of Barataria Bay</a> are front page news. We are seeing the affects of the Oil Spill everywhere.</p>
<p>One of the biggest concerns I have is the link to high blood pressure we keep hearing about, especially from the Oystermen and women who spent their lives in now contaminated water.The calls we have been getting are horrendous and come far to often these days. High blood pressure can lead to Heart Attacks and Strokes as well as death, please get checked out. We have heard that members of the National Institute of Health are coming in to investigate and we look forward to hearing the results.</p>

<h2>The BP Settlement Bonanza</h2>
<p>The Settlement for some is incredible news, property owners that border the gulf of Mexico can file claims for a number of reasons, especially if there is or was oil along the shore. Individuals and Business owners under the Settlement have a more concise methodology to figure their <span style="font-style: italic">BP Settlement</span> Claims. There are several factors that will bolster <u>BP Settlement</u> Claims, such as Industry and Zones. There are several other calculations after you establish the base line claims for your BP Settlement that can greatly enhance your bottom line. The BP Settlement is a windfall for those that qualify in most instances.</p>
<h2>The BP Settlement Fund</h2>
<p>Supposedly the new <a title="bp settlement" href="http://bpbusinessclaims.com">BP Settlement</a> Fund will be open for business sometime early June. Though it maybe relatively easy to establish your baseline loss, the other multipliers and factors that increase the loss are by no means easy, and in many instances they hard to understand, go figure.</p>

In some instances it may actually pay to take a Quick Pay, I never thought I would be saying that, in other instance the future trending allowed under the GCCF was much more favorable then under the <span style="font-style: italic">BP Settlement</span> for some claims. It really is a case by case issue.</p>
<h2>BP Settlement and other Issues Medical/Quick Pays/Oystermen</h2>
<p>The <u>BP Settlement</u> has addressed a lot of issues, we are hearing from may of you that you took <a title="bp settlement" href="http://bpclaims.org">Quick Pays</a> after being starved out, we are creating a database of you so that we can assist you in a number of ways, we will help you. We have been talking to several firms that are wiling to represent people in a massive class action against BP if these issues are not resolved. We have been told that the BP Quick Pays maybe back on the table, but not as a part of the BP Settlement as recently as yesterday. We will keep holding BP`s feet to the fire until this is resolved.</p>

<p><a href="http://bpclaims.org/wp-content/uploads/2012/04/bp-settlement4.jpg"><img class="alignleft size-thumbnail wp-image-2890" title="bp settlement" src="http://bpclaims.org/wp-content/uploads/2012/04/bp-settlement4-150x150.jpg" alt="bp settlement" width="150" height="150" /></a>  The <a title="bp settlement" href="http://bpsettlement.org"><span style="font-style: italic">BP Settlement</span></a> should have preliminary approval on Wednesday of this week, on the whole it does do the most amount of good for the most people, however the <u>BP Settlement</u> could do more. It could address the people that were victimized by Quick pays, it could pay people that are upstream from the fishermen such as the processors and give them better BP Settlement multipliers. The BP Settlement under Judge Barbier could truly make it right for so many people.</p>
<p>This will be Patrick Juneau`s swan song, in many peoples opinion. The BP Settlement will be ran by Judge Barbier and administered by Patrick Juneau, it is called the BP Court Supervised Settlement. The <a title="bp settlement" href="http://bpbusinessclaims.com">BP Settlement</a> promises transparency and quick payouts. You do not need an Attorney to be a part of the BP Settlement, though some websites out there tell you, you do, they lie.</p>
<h2>The BP Settlement and the Gulf Coast Claims Facility</h2>
<p>The Gulf Coast Claims Facility will be replaced by the new BP Settlement Fund. We have heard from Managers of the Gulf Coast Claims Facility that they will be leaving their jobs on June 1st to be replaced by the new staff that will be running the BP Settlement on June 4th. The infamous days of the Gulf Coast Claims Facility are almost over, leaving Ken Feinbergs reputation ever tarnished. <strong>The Delay, Deny, and Defend tactics they used were unconscionable</strong>, forcing people to take quick pays or lowered final pay outs, just to save BP money, need to be addressed in the BP Settlement, or BP Class Actions will most definitely come into play. There are people now organizing Class Actions for people who took Quick Pays, how do I know because we are one of them.</p>
<h2>The GCCF was an Abomination</h2>
<p>Never in the history of a disaster such as this was an organization allowed to run rampant and to take advantage of so many. Over 200,000 people took the Quick Pays, people were promised Interim Payments, but instead got bombarded by Quick Pays. The GCCF knew that many people were starving and facing foreclosures.</p>
<p>I never did understand why President Obama and the leaders in the Banking Industry did not put a freeze on foreclosures in the most affected areas. Instead debts piled up and the GCCF took advantage of their own Delay tactics, and as bills piled up for many, and they moved closer to the brink, they began to break out the Quick Pay schemes. People were economically forced to take them and we ALL know this as a fact.</p>
<p>People were told numerous times that the GCCF had lost their paperwork, only to find that often the paperwork was simply mislabeled and put somewhere else in their file, another Delay tactic.</p>
<p>The GCCF went on to lie to major Attorneys in the Oil Spill litigation and told them to take in all the BP Claims they could and put them into the Bulk Upload, this allowed the Attorneys to register the clients and the heads of the GCCF said they would pay these clients even though limited paperwork was on file at the GCCF.</p>
<p>Many people thought there claims had been filed, indeed they were, but they were not payable, we know this because we have talked with the people processing them at Brown Greer and they were laughed at and denied. It seems the GCCF would use these people as targets for Quick Pays as well. We have often heard of people that filed with Attorneys would be approached by members of the GCCF  waving 5k or 25k in front of them. These people never even filed claims individually with the GCCF. It is our belief that the GCCF used the many clients that were entered into the Bulk Upload as a contact list, to hit people that were disadvantaged by the whole Bulk Upload scheme so they could be hit by Quick Pays.</p>
<p>It seems as though the GCCF would tell one group one thing, and another group something else, which lead to confusion and aggravation and fewer BP Claims getting paid. People signed off their rights to further sue BP, just for a quick infusion of cash. The BP Settlement has the opportunity to right the many wrongs of the Gulf Coast Claims Facility.</p>

<p>We would appreciate any consideration of adding these people back into the BP Settlement so they could be properly compensated. Many of these people work on or in the water they have been exposed to Corexit and Oil and have suffered the side effects of elevated blood pressure, rashes, bloody stool, and death by heart attack and stroke.</p>
<p>These are the stories we hear day in and day out. They need your Help Judge Barbier, please grasp this opportunity to do what you can to Help them and get them into the BP Settlement..</p>
<h3>All this being said, here is why they need to be added into the BP Settlement.</h3>
<p>To whom this may concern&#8230;<br />
My name is John I am an Oyster Harvester of the Apalachicola Bay,for 30yrs now.I have surely seen better days out on the water since the BP oil spill and BP oil dispersant.<br />
My father died in the Apalachicola Bay,so I feel a special connection to him being out there.It hurts me so seeing how much things have changed since the BP oil spill and oil dispersant.</p>
<p>This past year has been by far one of the worst and hardest oyster harvesting years.Being an Oyster Harvester for 30 yrs now,I know every oyster bed from Alligator Point to Indian Pass.I can take you personally to any one of them and show you first hand the effects the BP oil spill and BP oil dispersant have caused.</p>
<p>The state oyster beds that did produce have severely been worked down by so many oyster harvesters having to work only in the beds that did produce.Has this hurt our providing for our families, ABSOLUTELY! The oyster catch went from 30 to 40 bags in a day to 12 bags on a good day.Oyster sales are down due to the BP oil spill.<br />
The first year,2010, BP made out like the BP oil spill and clean up would only last a year.That lead to the Quick Pay claim or pay-off.Yeah, BP gave you an option all right,take the Quick Pay claim or risk getting nothing.</p>
<p>Here it is 2yrs later and because of the BP oil spill and dispersant,the life for a Oyster Harvester is getting worse not better.Not only did the BP oil spill hurt the Oyster Harvesters,so has the BP oil dispersant.</p>
<p>It is in our bay,The Apalachicola Bay and BP is so responsible for it and our losses.Loss of income or lack of,reduce in production due to the catch of oysters per bags caught in a day.Also the limits set by Oyster dealers because of low oyster sales.</p>
<p>I took the Quick Pay and put that money into my oyster business counting on BP to do as they promised.My business has suffered greatly.I have had to sell to other oyster dealers not being able to have a sales route myself because of lack of catch and sales of oyster.Sales have been drastically reduced due to the BP oil spill having affected the Apalachicola Bay. Now I don`t qualify for the BP Settlement my last chance at being made right.</p>
<p>A family simply can not survive off this way of living anymore because of the BP oil spill and BP oil dispersant.</p>
<p>Who will help this starving way of life and living now?Who will make this better for the Oyster Harvester and other fishermen of The Apalachicola Bay and The Forgotten Coast Line?<br />

<p><strong>And Another</strong></p>
<p>My husband had invested much of his life to commercial fishing, always investing our hard earnings back into our business to have a nice home, to send our children to better schools, and school functions is a must with my husband, and I. We owe our lives to the Gulf of Mexico with its plentiful oysters, shrimp, and crabs to live upon, and to sell to our community consumers. My husband served our country as a Marine for four years, but that was years ago. I just want to let you know what a great husband and father he is, as well as a great person he his to our community, and state.</p>
<p>He was on the water about to go fish for crabs, but with so much stress that came with the BP oil spill he had a stroke on his sons birth date Aaron  3/16/1990. His blood pressure was 265 over 110 My husband stayed in Tulane medical centers ICU for 3 nights, and on the ground floor for 2 nights. The Doctor Mrs. Martin said it was acute stroke, saying it was &#8220;acute&#8221; meaning very bad. We are now in speech therapy, and taking the steps for him to get better.</p>
<p>BP or the press needs to know how they are making the commercial fishermen starve to take the $25,000.00. BP has our paper work, and the information needed to at least give us an intern payment, but never.</p>
<p>The BP assistant (rep) said in 2010 the oyster grounds were open. I say BULL, I have the paper clipping on that year, and lets not forget our oyster vessel could not work, due to the closure. BP must know with a 50ft oyster vessel, crab vessel with 400 traps are not just for there looks. Why would BP ever have a question about the payment if our family has these vessels in our own back yard?</p>
<p>Our family are now on food stamps, and getting little help from the church. I now have a $85,000.00 dollar hospital bill, and bills from his MRI, and other tests that the hospital ran to make sure he had no bleeding in his brain. He has lost more then the BP Settlement could every pay us now. Shame on you. We own a 50 foot oyster vessel, crab vessel with about 400 trips that we live on to pay our bills, but the spill has made the waters baron with no seafood to support our families living.</p>
<p>Can you see now how my husband had his stroke? I will call it a BP stroke! We never called an attorney yet, because we thought that would hold up any payment we might have received, but this is my husband! How can you do this to a family? Oh, and never mind about the main issue of people working at Popeye&#8217;s that receive money. Where are their vessels?</p>
<p>A very upset wife of a fishermen. I would like to ask whom ever is reading this if their loved one had a stroke? Well, let me tell you that the person whom had the stroke is not the same anymore. He can&#8217;t talk, he can&#8217;t think, he lost his humor. Very sad indeed.</p>
<p>I see the loss amount you would like me to give you, BP has taken my life, my husband, and a father away from me and my family. It would be hard to tell you how much of a loss this was. The hospital in itself is $85,000.00 and counting. To get my husband back to whom he was, priceless. I&#8217;m a very nice women, but this is the result of stress from the BP oil spill. Our total loss is $350,000.00 and counting.</p>
<p>We will Never give up Helping these people and others affected by the Oil Spill, for us it is personal and we are here for the Duration.</p>

That is good news for many people and businesses that still have <a title="bp claims" href="http://bpclaims.org">BP Claims</a> that have languished at the GCCF.</p>

We all know that BP and the GCCF preyed on these people and many of them were the hardest hit by the Oil Spill the Shrimpers, Crabbers and Oystermen. <p>Mr. Hood went on to say they need to  “nullify the illegal, illegally-obtained and unconscionable” Quick Pays. Mr Hood you are a hero to us and too many. <p>These people should be made whole under the BP Settlement. We had spoken to one of his aides just days before, they are taking this issue to task.</p>
<p>Robyn Greenwald who spearheaded the BP Settlement for the <a title="BP Medical Settlement and You" href="http://bpclaims.org/environmental-impacts/bp-medical-settlement-and-you/">Medical Class</a>, set forth that under the BP Settlement the Medical Class does the greatest amount of good for the most amount of people. We think that Robin did a masterful job of laying out the BP Medical Settlement. People will get some much needed economic relief, while still retaining their right to sue BP. There are some great Lawyers out there, and she is one of them, she is truly fighting for the people of the BP Settlement.</p>
<h3>BP Settlement: Charter Fishermen and Processors</h3>
<p>Attorneys argued that Shrimp processors needed to have a better RTP rate then a common business claim under the BP Settlement, this is pretty much a no brainer. They are directly tied to the health of the shrimping industry, this had to be had to be some sort of oversight.</p>
<p>In fact any Seafood processor whose down stream was affected by the Oil Spill should be given the same RTP`s as the people who supply them when they are so dramatically tied to the Health of the Gulf.
